Sally Ann Stansbury was charged with two counts of first degree arson, I.C. § 18-801, and one count of presenting false information to an insurer, I.C. § 41-1325. She pled guilty to all three counts and was sentenced to the Board of Correction for three indeterminate terms not to exceed three years, all to run concurrently. A notice of appeal was filed, followed closely by a motion in the district court to reduce her sentences under I.C.R. 35. The district court denied the motion after a hearing and Stansbury filed an amended notice of appeal. She raises two issues: (1) whether the sentences imposed constitute cruel and unusual punishment under the eighth amendment to the United States Constitution; and (2) whether the court abused its sentencing discretion. We affirm.
