On June 16, 1967, a complaint was filed in the Justice court of Ada County charging Samuel G. Bailey, the appellant, with
the crime of burglary in the second degree, alleged to have been committed in Boise on June 14, 1967. Bailey was arrested
October 12, 1967. He moved to quash the complaint, which motion was denied. On December 13, 1967, a preliminary examination
was held and Bailey was bound over for trial in the district court. An information was filed against Bailey in the district court on January 12, 1968. He was subsequently tried before a jury,
which returned its verdict of guilty of the crime of burglary in the second degree. The district court entered its judgment
of conviction finding appellant guilty of the crime charged, and sentenced him to a term of not to exceed five years in the
state penitentiary. From that judgment Bailey appeals.
